DENVER MAN WINS $80,000 AFTER THIS BODYCAM ARREST — DEPUTIES INSTANTLY REGRET IT!

A routine roadside encounter takes an unexpected turn when A DENVER-AREA MAN IS ARRESTED WHILE RECORDING A SHERIFF’S DEPUTY during a traffic stop. What makes the incident especially significant is what the body-camera footage reportedly captured after the arrest, including another law-enforcement official questioning whether there was probable cause.

The incident involved BARRY ZATKALIK, a former reserve officer with the Denver Police Department. In February 2024, Zatkalik reportedly stopped near a traffic stop on U.S. 85 in Adams County after observing a deputy’s driving. He began recording and asked the deputy for identifying information so he could make a complaint.

THE SITUATION ESCALATED INTO AN ARREST when Deputy Walter Berlinski demanded Zatkalik’s identification and ultimately arrested him on an obstruction allegation. Body-camera footage became an important part of the dispute, documenting the interaction and the response of other officers who arrived at the scene.

One particularly notable moment came when A SUPERVISOR ARRIVED AND QUESTIONED THE BASIS FOR THE ARREST. According to reporting on the footage, Sergeant Eric Brodheim told Zatkalik that members of the public could legally record a traffic stop and ask a deputy for identifying information. The footage also reportedly captured Berlinski acknowledging concerns about the strength of the arrest.

THE CASE EVENTUALLY LED TO AN $80,000 SETTLEMENT. Zatkalik’s attorney sent Adams County a legal notice threatening a civil-rights lawsuit, alleging wrongful arrest and violations of his First Amendment rights. The county ultimately agreed to pay $80,000, and no formal lawsuit was filed.

The incident also resulted in DISCIPLINARY ACTION AGAINST THE DEPUTY. Adams County issued Berlinski a letter of reprimand concerning the encounter, including the public’s right to record or photograph law-enforcement activity and the requirement to provide identifying information when requested.

BODYCAM FOOTAGE BECAME CRUCIAL EVIDENCE in understanding what happened. The recording provides a contemporaneous account of the encounter and illustrates how video evidence can become central when the legality of an arrest is later challenged.

From a traffic stop being recorded to an unexpected arrest and eventually an $80,000 CIVIL-RIGHTS SETTLEMENT, the case highlights the importance of documentation, constitutional rights, and accountability during encounters between law enforcement and the public.
